DEFINITIONS OF LEGAL JARGON

Estate

Your net worth of assets, or if your Estate is insolvent,your liabilities.

Executor

The person or organisation named in the will to carry out the instructions of a deceased person. The majority of the time the Executor and Trustee are the same person(s).

Administrator

A person who “administers” the estate by paying estate debts and distributing any assets to the beneficiaries.

Probate

The seal issued by the High Court to prove a will is valid and give authority for the executor/trustees to administer and estate if the assets exceed $15,000.00 or land is involved.

Trustee

A person or company or organisation that holds property on trust for a beneficiary.

Intestate

Dying without a will.
